For most of his 20 years of practicing law, Wilson Eaton has concentrated his practice in the representation of employers in labor and employment law matters. He takes a holistic and preventative approach to this area of the law. Wilson capitalizes on his experience to craft practical business solutions to guide employers through the complexities of labor and employment law.

The Law Office of J. Wilson Eaton III, PLLC consults with and advises employers on day to day issues to minimize labor and employment law risk. Wilson's goal is to anticipate problems before they occur, assist the client in calculating risk, and chart a course to avoid or minimize those problems.

In this preventative/consultation role, Wilson frequently drafts employment handbooks, policies and procedures, and reviews existing ones. He also drafts internal protocols to help clients integrate multiple employee leave laws, such as the Family and Medical Leave Act, the Americans with Disabilities Act, and workers' compensation law, with the employer's attendance/absence policy.

When employers are sued, Wilson defends their interests in state and federal courts and before administrative agencies. Wilson's courtroom experience in representing management in labor and employment matters includes jury trials, bench trials, administrative agency trials/hearings (such as the National Labor Relations Board), employment law arbitrations through the American Arbitration Association, and labor law arbitrations through the Federal Mediation and Conciliation Service.

Recent successes include:

  • Avoiding any willful citation from OSHA as a result of a six-month investigation of a chemical-industry employer with two fatalities in a two-week period;
  • Obtaining the dismissal of employment discrimination claims against a human resources director in a federal lawsuit; and
  • Obtaining a favorable settlement for a multi-national employer in a two-year, hotly-contested OSHA matter pending before the Occupational Safety and Health Review Commission
